§1Who you're agreeing with

Kyzen Mobile ("Kyzen," "we," "us") is a wellness tracking app distributed on the Apple App Store and on the web at kyzenos.com. These Terms form a binding contract between you and Kyzen. If you don't agree to any part, don't install or keep using the app.

§2Eligibility

You must be at least 13 years old (16 in the European Economic Area, United Kingdom, and Switzerland) to use Kyzen. If you're under 18, you confirm a parent or guardian has reviewed these Terms with you. Kyzen is not directed at children under 13 and we don't knowingly collect their data.

§3Wellness disclaimer — IMPORTANT

Kyzen is a wellness and self-tracking tool. It is not a medical device and it does not provide medical advice, diagnosis, or treatment.

Sleep summaries, calorie suggestions, workout plans, hydration targets, and any AI-generated coaching shown in Kyzen are for informational and motivational use only. Always consult a qualified healthcare professional before starting a new diet, exercise program, supplement, or sleep change — especially if you are pregnant, recovering from injury, managing a chronic condition, taking medication, or under 18. You are responsible for your own health decisions. If something Kyzen suggests doesn't feel right for your body, don't do it.

About the AI assistant: it can be wrong, and it is not a person.

Kyzen's assistant is generative AI. It can misread a photo, miscount a macro, misremember something you told it, or state something confidently that simply isn't true — so check anything that matters before you act on it. Food-photo estimates in particular are estimates: they are a fast way to log a meal, not a laboratory measurement, and you can edit every number before it is saved.

We screen what you send to the assistant before it reaches the model, and the model has its own safety training on top of that. Neither is perfect. If you deliberately try to push the assistant into producing offensive, harmful, or otherwise objectionable output — by rephrasing, role-play, jailbreak prompts, or any other workaround — you are choosing that result, you accept responsibility for it, and it is a breach of the conduct rules in §6. Kyzen is not liable for output obtained that way. If the assistant produces something objectionable during ordinary use, we want to know: email support@kyzenos.com.

Never use the assistant for an emergency. If you are in crisis or think you may be having a medical emergency, contact your local emergency number or a crisis line immediately — in the US, call or text 988 for the Suicide & Crisis Lifeline, or 911.

§4KY currency, cosmetics, and store purchases

KY is an in-app virtual currency you earn by hitting goals and streaks. KY has no cash value, cannot be exchanged for real money, cannot be transferred between accounts, and cannot be redeemed outside Kyzen.

All cosmetic items you unlock with KY (banners, effects, badges, emoji packs, themes) are final-sale digital goods. Once unlocked, they are non-refundable, non-exchangeable, and tied to your account. We may add, remove, retune, or rotate cosmetics at any time without notice. If your account is suspended or terminated for violating these Terms, your KY balance and unlocked cosmetics may be forfeited without compensation.

We may also adjust KY-earning rates from time to time as part of normal app tuning. Past KY balances will not be retroactively altered.

§5Subscriptions and billing

How your subscription is billed, and how you cancel it, depends on where you bought it. Your purchase confirmation email states which applies.

Bought on kyzenos.com — the subscription is sold by Kyzen and billed by our payment processor, Stripe. Manage or cancel it any time from the billing portal in your Kyzen account settings. Refunds are handled by us: email support@kyzenos.com.

Bought inside an Apple app — the subscription is sold through the App Store and billed by Apple under your Apple ID. Manage or cancel it in iPhone Settings → Apple ID → Subscriptions. Refunds for those charges are handled by Apple under its standard refund policy; Kyzen cannot issue them directly — request one via reportaproblem.apple.com.

Either way, subscriptions auto-renew at the end of each period unless you cancel at least 24 hours before renewal, and cancelling stops future renewals rather than refunding the current period.

§6Your account, your content, and how to behave

You're responsible for keeping your account credentials safe and for everything that happens under your account. If you suspect unauthorized access, change your password and contact us.

You retain ownership of the content you upload (avatars, profile text, dream notes, workout logs, food logs, etc.). By uploading content you grant Kyzen a non-exclusive, worldwide, royalty-free license to store, transmit, and display that content as needed to run the app on your devices and any backups. We don't sell your content to advertisers and we don't license it to third parties for training generative-AI models.

There is zero tolerance for objectionable content or abusive behaviour in Kyzen.

Kyzen has a social layer — friends, a public activity feed, kudos, leaderboards and shared planning boards. Anywhere you can be seen by another person, you agree not to post, send, or display content that is: unlawful; hateful or discriminatory; harassing, bullying, or threatening; sexually explicit; graphically violent; promoting self-harm, disordered eating, or dangerous weight-loss practices; promoting illegal drugs; spam, scams, or phishing; impersonating another person; infringing someone else's rights; or sharing another person's private information without their consent. You also agree not to attempt to break, overload, or automate access to the service.

We enforce this. Public text and images are screened automatically before they are published. Every member profile carries Report and Block controls: blocking hides you from that person and them from you immediately, and reports go to a moderation queue that we review. We aim to remove violating content and remove or suspend the accounts responsible within 24 hours of a report. We can remove content or terminate an account for a breach of this section at any time, without notice where the harm is serious. If you believe we got it wrong, email support@kyzenos.com and a human will look at it.

§7Limitation of liability

To the maximum extent permitted by law, Kyzen and its officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app — including injury, lost data, lost sleep, missed workouts, or third-party charges.

Our total liability for any claim related to Kyzen will not exceed the greater of (a) the total amount you paid us through Apple in the 12 months before the claim, or (b) USD $100. Some jurisdictions don't allow this limitation; in those places it applies to the fullest extent allowed.

§8Indemnification

You agree to defend and hold Kyzen harmless from any claim arising out of your misuse of the app, your violation of these Terms, or your infringement of any third-party right.

§9Termination

You can stop using Kyzen at any time by deleting the app (iOS) or signing out and clearing your browser's site data (web), and, if you want, requesting account deletion in Settings → Privacy.

We may suspend or terminate your access if you violate these Terms, abuse the KY economy (botting, exploiting bugs, fraudulent chargebacks), or use Kyzen in a way that creates risk for other users or the platform. We're not required to give advance notice for termination tied to fraud or safety.

§10Disputes — arbitration and class waiver

Any dispute between you and Kyzen will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Rules, in the State of Delaware, United States. You and Kyzen each waive the right to a jury trial and the right to participate in a class action.

If you live somewhere this clause is unenforceable, the dispute will be heard in the federal or state courts of Delaware, and you and Kyzen consent to that jurisdiction.

EU residents retain any non-waivable consumer-protection rights under their local law; this clause does not strip those.

§11Apple App Store terms

These Terms are between you and Kyzen, not Apple. Apple is not responsible for Kyzen or its content. To the extent these Terms grant rights or remedies, Apple is a third-party beneficiary and may enforce them. App Store usage rules in Apple's standard license terms also apply to your installation of Kyzen.

§12Changes to these Terms

We may update these Terms occasionally. If we make a material change (price, new clause, jurisdiction shift), we'll prompt you to re-accept inside the app. Continuing to use Kyzen after a material change means you accept the new Terms.

§13Communications and email opt-in

By opting in to the weekly email digest, you agree to receive occasional product updates and announcements about Kyzen and future Jackson & Co products. You may unsubscribe at any time using the link at the bottom of any email or by turning the toggle off in Settings → Notifications → Weekly recap email.
